The Virgin Islands Taxi Association (“VITA”) appeals the Superior Court’s June 10, 2016 memorandum opinion and order dismissing its complaint with prejudice. Although VITA’s request for injunctive relief is moot and its request for contempt sanctions was appropriately reversed by the Appellate Division of the District Court of the Virgin Islands, the Superior Court erred in dismissing VITA’s complaint for failure to prosecute and VITA is still entitled to pursue its claim for damages.
