GILL, Associate Justice.
W. S. Holman, the appellant, applied for and procured the appointment as administrator of the estate of Duncan Dew, deceased. The proceedings were had in the County Court of Fayette County, Texas, and under the order thus procured he qualified and acted as such administrator for about three years, managing the property under the direction of the probate court.
