It is a suit for dam*593ages for personal injuries sustained while plaintiff, in the discharge of his dnties as a messenger for the Southern Express Company, was riding in an express car, part of a passenger train operated by the defendant railroad company. The train was wrecked, and the injuries to plaintiff resulted.
