SIMPSON, Circuit Judge:
James Lee Worthington was charged in a one count indictment with possessing approximately 843 pounds of marijuana with intent to distribute, in violation of Title 21, U.S.C., Section 841(a)(1). He pled not guilty, and was found guilty as charged by the district court in a bench trial, after waiving a jury. The hearing on Worthington’s motion to suppress the evidence as to his warrantless arrest and the search of his aircraft was conducted simultaneously with the trial on the merits.
