PRELIMINARY ORDER IN MANDAMUS, AS MODIFIED, MADE ABSOLUTE

FLANIGAN, Presiding Judge.

This is a mandamus proceeding, (Rule 94),1 in which the relators are Sherwood Graves and Mary Graves, his wife, and respondent is judge of the Circuit Court of Ozark County. This proceeding stems from civil action CV 580-13CC, (the underlying action), pending before respondent. In the underlying action Russell M. Reid is plaintiff and the Graveses are two of six defendants. In this court the Graveses sought, and obtained, a preliminary order in mandamus. Thereafter Russell M.
