Judgment unanimously reversed on the law, defendant’s motion to suppress granted and defendant remanded to Ontario County Court for further proceedings on the indictment. Memorandum: Defendant contends that the suppression court erroneously concluded that the police had probable cause to arrest him or pat him down in a search for weapons and that any statements made by him should have been suppressed.
