Defendant appeals from a judgment of the Supreme Court, Kings County, rendered June 23, 1977, convicting him of assault in the second degree, criminal possession of stolen property in the second degree and unauthorized use of a vehicle, upon a jury verdict, and imposing sentence. Judgment affirmed. Particularly in light of the fact that the defense theory upon trial was that defendant was too intoxicated at the time the crimes in question were committed to be able to form the requisite criminal intent, defendant complains that the traditional charge of the trial court on intent constituted a…
