— This is an action for damages for personal injuries. Plaintiff recovered a verdict and judgment in the sum of $1624.S8 and defendant has appealed.

The facts show that-plaintiff, together with others including one Mastin, ay as employed as a section hand by the defendant iu laying a neAV railroad track into a ballast pit.
