The petitioner, Sam A. White, in his application for a writ of habeas corpus, says that he is illegally restrained of his liberty by the warden of the penitentiary, by virtue of a commitment from the district' court of Okfus-kee county predicated upon a judgment of that court rendered October 15, 1923, adjudging him guilty of manslaugh ter in the first degree.
