This proceeding involves principally the question whether or not one Robert E. Barringer, called the petitioner herein, is an heir and entitled to a portion of the property in this state of Carl Ray, deceased.

The record discloses the following facts: Carl Ray under the name of Melvin A. Barringer was married on September 1, 1901. The petitioner, Robert E. Bar- ringer, was born of this marriage on June 18, 1902, in Chicago, Illinois.
