OPINION OF THE COURT

ROBERTS, C. J.

The three appellants, Benjamin Trujillo, Virgilio Trujillo and Lucario Fresquez, together with the two defendants, Pedro Mondragon and Max Vigil, were all indicted at the June, 1918, term of the district court of Taos county, for the murder of Jose C. Fresquez. The case was not tried until the June, 1919, term of the said court, before which time Pedro Mondragon and Max Vigil died.
