Appeal from a judgment of the Superior Court of Mendocino County, and from an order refusing a new trial. The facts are stated in the opinion.

Belcher, C. C.

The defendant was convicted of manslaughter, and sentenced to serve a term of four years in the state prison. He moved for a new trial, and has appealed from the judgment and order denying his motion.

The homicide was committed on the twenty-second day of May, 1887, in Mendocino County. Immediately after its commission defendant fled and was arrested two days afterwards, while traveling down the coast in Sonoma County.

It is not claimed that the evidence was insufficient to justify the verdict, but it is insisted that several erroneous rulings were made by the court, which…
