PARKER, Justice.

This is a suit on two promissory notes brought by appellant, Robert M. Nelson, as plaintiff in the trial court, against appel-lee, John H. Powell, as defendant below. The case was submitted to the jury on special issues. The answers of the jury were favorable to Robert M. Nelson. Upon motion of appellee, the trial court disregarded the findings of the jury and entered judgment that appellant take nothing against appellee, notwithstanding the ver-diet.

On August 30, 1960, John H. Powell signed two notes as follows:
