17th judicial district, specially presiding, In this case a preliminary injunction was granted to restrain the defendants, or *101one of them, Daniel B antes, from mining coal from the lands of the plaintiff; a preliminary hearing was had, at which the injunction was continued; the bill was filed, which was replied to by answer setting up, inter aim, want of jurisdiction of a court of equity, and a motion was presented asking to have the case certified to the law side of the court.
