GARWOOD, Circuit Judge:
This is an appeal from the judgment of the district court denying appellants’ petition for a writ of habeas corpus in which they seek to set aside a final order of deportation, the validity of which has been previously upheld by this Court. The primary questions are whether the district court had statutory authority to refer their petition to a federal magistrate for a hearing, and if so, whether appellants’ petition raised new grounds which could not have been presented in the deportation proceedings or on the prior appeal.
