Appellant Broadfoot, as trustee in bankruptcy for La Privilege, Inc. d/b/a Pierre’s Rue de Paris, Pierre Merlot and Marie Merlot, sued Aaron Rents, Inc., Abco Builders, Inc. (Abco), C. Philip Richards, Harwell S. Huggins, M. William Breman and Citizens & Southern National Bank (C & S) for the 1985 collapse of brick veneer from *298several stories of a building’s east wall onto the premises the Merlots rented for their restaurant business.
