This is a suit in equity, brought by a holder of preferred stock in the defendant company, by which the plaintiff seeks to restrain the defendant Henry from prosecuting certain proceedings, now pending, to enforce the payment of certain notes which he received for common stock issued by the defendant company to him; and to compel him to surrender said notes for cancellation and to pay over to the company or its trustees such sums as were paid by the company to him for such stock.
