The appellants, Tynburg & Co., brought an action against the firm of Wm. Cohen & Co., in the county court of Washington county, to secure about eight hundred dollars which the latter owed to them, and subsequently they sued out an attachment, which was levied on about nine hundred dollars worth of goods. The petition alleged that Isaac and Herman Cohen composed the defendant firm, and the attachment bond was made to them as defendants under the name of Wm. Cohen & Co.
