On May 21, 1966, the defendant, Timothy Spears was married in DuPage County. A reception followed and about 9:30 p. m., two deputy sheriffs came to the home where the reception was being held in response to a radio call. They first went to the front door and then walked to the rear of the building where a number of people were congregated. They made inquiry for the owner of the home, at which point the defendant, Timothy Spears, walked up to them and said, “We don’t need any cops here.” He then hit one of the deputies in the head.
