KRUEGER, Judge.
*408The offense is driving a motor vehicle on a public highway while intoxicated. The punishment assessed is a fine of fifty dollars.
It was the state’s theory, finding support in the testimony, that appellant drove a motor vehicle on a public highway in Wichita County while intoxicated. It was appellant’s theory, supported by testimony, that he was not intoxicated at the time and place in question.
