GALSTON, District Judge.

This action was removed by the defendant from the state court on the ground of diversity of citizenship.

There are two causes of action alleged in the complaint.

As to the first cause of action, it is said that Samuel Herman, a resident of Kings County, was a passenger on a plane owned and operated by the defendant; that the plane was caused to crash land on July 17, 1951 as a result of the carelessness and negligence of the defendant near the Charles River in the vicinity of Richmond, Virginia; that as a result of the defendant’s negligence, plaintiff’s intestate was…
