—Proceeding pursuant to CPLR article 78 (transferred to this Court by order of *699the Supreme Court, entered in Ulster County) to review a determination of respondent Commissioner of Correctional Services which found petitioner guilty of violating a prison disciplinary rule.

Petitioner, an inmate at Eastern Correctional Facility in Ulster County, was found guilty of violating the prison disciplinary rule which prohibits the unauthorized use of controlled substances. The charges stem from the positive results of a random urinalysis test on petitioner which indicated the presence of both opiates…
