STORY, Circuit Justice.
An information, of seizure was, on the 13th February, 1809. filed against the Bolina and cargo, for not unlading her cargo, or giving bonds, pursuant to the 3d section of the act of January, 1809, c. 72 [4 Bior. & D. Laws, 190; 2 Stat. 507]. Upon the hearing in this court, the material facts appeared to be: — That on the 17th of January, 1809, the schooner Boli-na lay at Newburyport, nearly laden with a cargo of fish and lumber.
