The defendant, Alfred Notley Hoofer, was charged in the district court of Oklahoma county with the crime of murder; was tried, convicted of man slaughter in the first degree, and sentenced to serve 10 years in the State Penitentiary, and has appealed.

The Attorney General has filed a motion to strike the case-made for the following reasons:
