(After stating the foregoing facts.) The plaintiff in error contends that the court erred in overruling his objection'to the amendment to the petition, on the ground that it set out a cause of action new and distinct from that declared on in the original petition and inconsistent therewith. This ground of the demurrer was properly overruled. The cause of action declared on in the original petition was one for treble damages for an alleged violation of the rent regulations promulgated by the Office of Price Administration under the provisions of the Emergency Price Control Act of…
