This was an action commenced before a justice, of the peace and taken by appeal to the Circuit Court.

This action was founded on the first section of the Trespass Act (Wagn. Stat., 1345). The statement of the plaintiff's causes of action filed with the justice, was for wrongfully and unlawfully entering by the defendant upon plaintiff’s land ; and for cutting and carrying away therefrom timber trees, to the value of thirty dollars; for which several trespasses, the plaintiff in his statement claimed damages to the amount of thirty dollars, and asked judgment that his damages should be trebled…
