Defendant, John W. Green, appeals from the trial court's order denying his Crim. P. 85(c) motion for post-conviction relief. We vacate the order and remand for further proceedings.

In October 1995, defendant was charged with committing a second degree sexual assault on his girlfriend. In February 1996, he pled guilty to intimidating a witness, a class four felony, based on events occurring after the alleged sexual assault. The prosecution dismissed other pending charges, and in March 1996, the court sentenced defendant to six years in the Department of Corrections…
