Appeal by the defendant, John L. Miller, from a judgment of the Supreme Court in favor of the plaintiff, entered in the office of the cleric of the county of New York on the 6th day of June, 1907, upon the verdict of a jury for $8,500, and also from an order entered in said clerk’s office on the 7tli day of June, 1907, denying the defendant’s motion for a new trial made upon the minutes.

Clarke, J.:
The plaintiff’s evidence tended to establish that he had been for nearly two years a tenant of the defendant in his office building situated on the southwest corner of Sixty-fifth street and Broadway in the city of ¡New York; that there were two entrances to the building, one from Sixty-fifth street and the other from Broadway ; that it was furnished with a passenger elevator for the use of tenants in charge of defendant’s servant, an elevator boy; that on the morning of October 11, 1904, the plaintiff had prior to the accident twice used the elevator; that at about eleven o’clock…
