This is an action of trespass on the case for negligence. At the trial of the case in the superior court the defendant rested at the conclusion of the plaintiff’s evidence and moved that the trial justice direct the jury to return a verdict in its favor. The plaintiff then moved that the trial justice direct the jury to find in her favor on the question of liability, and leave to the jury only the question of damages. The trial justice thereupon granted the defendant’s motion and denied that of the plaintiff. She is now prosecuting her bill of exceptions in this court to the above rulings of…
