On tbe 4tb day of August, 1908, a suit was commenced in. the circuit court of Pike county against tbe Phoenix Insurance-Company to recover tbe sum of $100; that being tbe face value-of a certain insurance policy issued by tbe company in favor of Burton Bridges on a certain dwelling located in tbe town of' Summit, insuring same against loss by fire. Tbe suit was begun in tbe name of E. M. Baco-t, Emily Bridges, and Burton Bridges, for tbe use of E. M. Bacot and Emily Bridges, and contains two counts.
