OPINION
FRY, Judge.
{1} The State appeals from the district court’s order disqualifying the Second Judicial District Attorney’s Office from prosecuting this case. The present case stems from charges against Defendant for criminal sexual penetration, criminal sexual contact of a minor, contributing to the delinquency of a minor, and bribery of a witness. Defendant’s trial on these charges resulted in a hung jury on several counts.
