Plaintiff in error, Sam Triolo, was in the criminal court of Cook county indicted, tried, convicted and sentenced to life imprisonment in the Joliet penitentiary for the murder of William Gearty, and he has brought the record to this court for review upon writ of error.

The evidence was not set out in detail in the bill of exceptions, but it is stated therein that the evidence introduced on the trial of the cause was conflicting and might have warranted the jury in finding the defendant guilty of murder or manslaughter or not guilty; that the People, to maintain the issues on their part,…
