On November 10, 1945, an information in five counts drafted under the several provisions of Section 849.09, Fla. Stats. 1941 (FSA), was filed in the Circuit Court of Marion County, Florida, against Fletcher Fuller, Abner Fuller, Emory Knight and Bernard Knight. Fletcher Fuller and Abner Fuller each filed motions for severance, reciting various grounds for the entry of an order granting separate trials but these motions were denied.
