(Meridian), the developer of a subdivision in the town of North Attleborough (town) known as Windchime, challenges the allowance of a motion for summary judgment in favor of the defendants (collectively, Earth Tech), an engineering firm hired by the town as a consultant to inspect Meridian’s work, on grounds that Earth Tech was negligent in failing to identify deficiencies *129in work performed by Meridian’s contractor that Meridian was forced to correct at a considerable additional cost.
