TAYLOR, Justice.

The defendant (respondent) Milner Low Lift Irrigation District was organized in 1921. At that time it acquired by purchase the water rights and the incomplete diversion and distribution system of the Murtaugh Canal Company. The purchase price ultimately agreed upon was $486,864 to be paid in bonds of the district. At that time there were 8114.4 acres of iand within the district.
