INGRAHAM, District Judge.
Petitioner, Percy N. Hendrick, is a prisoner in state custody pursuant to the judgment and sentence of the Criminal District Court No. 4 of Harris County, Texas, in six separate causes. He pled not guilty to the charge of burglary in cause No. 91265, which indictment also *995contained an habitual criminal count. After trial, in which he was found guilty as charged, petitioner was sentenced to life imprisonment to commence on July 13, 1960.
