OPINION AND ORDER

Before the Court are defendant’s “Motion to Dismiss Under FRCP 12(b)(6) for Failure to State a Claim Upon Which Relief Can Be Granted” (Docket No. 18), and plaintiffs “Opposition to Dismiss Pursuant to Federal Rule of Civil Procedure 12(B)(6)” (Docket No. 19). For the reasons explained below, defendant’s motion is DENIED.
