Appeal by the defendant, John T. O’Brien, from an interlocutory judgment of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of Clinton on the 19th day of Hay, 1913, upon the decision' of the court after a trial before the court without a jury. The action was brought to foreclose a mortgage on real estate.

Howard, J.:

The parties to this litigation became acquainted in 1890. At that time the husband of the plaintiff was assistant manager of the Chateaugay Ore and Iron Company; the defendant was employed as a station agent by that company. After a time the plaintiff’s husband was called away from Clinton county oermanently to San Domingo, where he became employed. He seems to have made money rapidly in a modest way.
