Frederic Duelin, the defendant in error, brought' this suit against the Galveston, Harrisburg & San Antonio Railway Company, the plaintiff in error, to recover damages for personal injuries. He obtained a judgment in the trial court, which was affirmed by the Court of Civil Appeals. This writ of error is sued out for the purpose of reversing the judgment.

The injuries complained of were the result of a collision at a crossing of the railroad and a public highway between a train of the defendant company and a wagon of the plaintiff, in which he was riding. The ground…
