Defendant-appellant Baurle pleaded guilty to a charge of Second Degree Burglary and received a sentence of not less than two nor more than five years. Thereafter, pursuant to Ind. Rules of Procedure, Post-Conviction Remedy Rule 1, Baurle filed a petition contending that the guilty plea was not knowingly and intelligently entered. From a denial of that petition Baurle appeals.

The record reveals that the guilty plea arose from plea bargaining negotiations wherein the Jackson County Prosecutor agreed to dismiss a robbery charge pending against Baurle in exchange for his guilty plea to the charge…
