The Court does a very unusual thing when, after refusing to consider the petition for rehearing and allowing the parties an opportunity to argue their respective positions, the Court addresses arguments *463raised in Bunker Hill’s petition for rehearing. The Court should either grant the petition for rehearing and allow the parties an opportunity to argue their respective positions, or strike all references to arguments made in that petition from this opinion.
