MALONEY, District Judge.

Before the Court is Defendant’s Motion for Summary Judgment and Plaintiffs Motion for Partial Summary Judgment. The motions are opposed. After considering the motions, the responses, the replies, and the pleadings in this case, the Court is of the opinion that Defendant’s motion for summary judgment should be granted and Plaintiffs motion for partial summary judgment denied.
