Heed was indicted in the Desha Circuit Court, for the murder of “a certain Wyandott Indian, whose name is [was] unknown to the grand jury.” Tie was tried upon the plea of not guilty, convicted of manslaughter, and sentenced to the penitentiary for four years. Motion in arrest of judgment and for a new trial overruled, and appeal to this court.
