Error to two judgments of the Circuit Court of Augusta county, rendered May 24, 1898, and Kovember 14, 1898, respectively, in an action of trespass on the case, wherein the plaintiff in error was the plaintiff, and the defendant in error was the defendant.

This action was brought by Marshall’s administratrix in the Circuit Court of Augusta county in April, 1898, against the Valley Railroad Company for the recovery of damages by reason of the death of her intestate, William EE. Marshall, which she alleges was caused by the negligence of the defendant company.

At the May term, 1898, the case was tried by a jury, which rendered a verdict in favor of the plaintiff for $2,700, which, upon the motion of the defendant, was set aside, as being contrary to the law and the evidence. At the Kovember term the…
