Appeal from District Court, Cotton County; J. T. Johnson, Judge. Bud Foster was convicted of the crime of false pretenses and sentenced to be imprisoned in the state penitentiary at McAlester for a period of six months, and he appeals.

Bud Foster was convicted in the district court of Cotton county of the crime of false pretenses, and prosecutes an appeal to this court from such judgment of conviction, and among other assignments of error contends that the trial court erred in not sustaining his demurrer to the state’s evidence and directing a verdict of not guilty, in that there is no competent evidence to sustain the allegations of the information. With this contention this court is compelled to agree, although the record discloses conduct on the part of the plaintiff in error- which merits, not only condemnation, but…
