Defendant, State of Louisiana Board of Trustees (Board), appeals the trial court’s grant of summary judgment on the issue of coverage in favor of plaintiffs, Mr. and Mrs. Douglas James.

FACTS

The Board administers the State Employees Group Benefits Program (Program) which prior to July 1,1985, provided benefits for in-home nursing care of a registered nurse or licensed practical nurse when medically necessary and prescribed by a licensed medical doctor.
