Action by Merritt Thorn, Jr., by his next friend, Merritt Thorn, Sr., against the Western Union Telegraph Company, for personal injuries caused by defendant’s negligence. WALES, District Judge.

This was an action by Merritt Thorn, Jr., by his next friend, Merritt Thorn, Sr., against the Western Union Telegraph Company, to recover damages for injuries received by the plaintiff, and alleged to have been caused by the negligence of the defendant. The action was originally brought in a court of New Jersey, and was removed by the defendant to the United States circuit court. The evidence was that on the 17th day of November, 1891, fit about 4 p. m., the plaintiff, then aged between 10 and 31 years, was walking along Delaware avenue, in Camden, N. J., carrying a…
