The plaintiff in error states in His brief:

“The contention of the plaintiff in error resolves itself into the following:
“(1) There is no competent evidence to support the court’s finding that the plaintiff in error, Blacklock, was ever a co-partner.
“(2) If the defendant and plaintiff in error,' Blacklock, ever was a copartner, he did not become a member of the copartnership until December, 1912.
“(3) Not becoming a partner until December, there was an entire failure of evidence to show that the plaintiff in error, Blacklock, ever assumed or agreed to…
