Appeal by the plaintiff, Carl Fischer-Hansen, from a final judgment of the Supreme Court in favor of the defendant The Brooklyn Heights Railroad Company, entered in the office of the clerk of the county of Kings on the 8th day of February, 1900, upon the decision of the court rendered after a trial at the Kings County Special Term sustaining said defendant’s demurrer to the amended complaint.

The plaintiff is an attorney and counselor at law, and he has brought an equitable action for the purpose of procuring the determination and securing the enforcement of his lien created in an action brought by him as attorney in behalf of one of the defendants against the other.
