This appeal concerns whether this court or the district court has jurisdiction over matters relating to a citizen petition filed pursuant to Food and Drug Administration (“FDA”) regulations promulgated under the Food, Drug, and Cosmetic Act (“the Act”), 21 U.S.C. § 301 et seq.
